and who is breaking the law?

The attack on the citizen led petition effort is multipronged. The uniparty and their henchmen have attempted to block petitions with the failed HB1140, recently drafted County Ordinances and other intimidation tactics. Yesterday’s Lawrence County Commission meeting gives us another opportunity to expose more officials working against the people and the Constitution they swore an oath to. WATCH THE VIDEO BELOW.

HB1140 attempted to give legal authority to the commissions to throw out petitions by adding this verbiage:

Unless the board determines the petition’s proposed measure 9 is in contravention of state or federal law, which determination may be appealed to circuit 10 court in accordance with § 7-8-27

Why? Because the statute regarding petitions says this:

7-18A-13. Board action on initiative petition--Submission to voters.

If a petition to initiate is filed with the auditor, the auditor shall present it to the board of county commissioners at its next regular or special meeting. The board shall enact the proposed ordinance or resolution and shall submit it to a vote of the voters in the manner prescribed for a referendum within sixty days after the final enactment. However, if the petition is filed within three months prior to the primary or general election, the ordinance or resolution may be submitted at the primary or general election.

SHALL enact the proposed ordinance, SHALL submit it to a vote of the voters. Not may, not if you want to, not if you agree…..SHALL.

On Tuesday 3-12-2024 Lawrence County Commission voted 5-0 to deny the petition submitted by the voters. Although the judicial branch is the only branch of government that has any authority to determine the legality of a petition, they did it anyway.

Lawyer Sara Frankenstein, contracted by Lawrence county at $300/hour, gave a 33 minute power point on HER opinions. (When the citizens opportunity came, the chair told them to keep their comments short and they weren’t going to allow much public comment. WHAT?) Ms. Frankenstein has been given an opportunity to speak in McPherson County too, and is heavily involved with their State’s Attorney Austin Hoffman. Everyone should be looking for how much money your county is wasting by hiring Sara Frankenstein to fight the people. File a public records request for the contract and the expenditures.

By the way, are the State’s Attorneys in any county worth what we are paying them? Apparently they don’t know ANYTHING about election law because they can’t defend the lawsuits against the auditors that they caused by their ignorant denials of public records, and obviously can’t help themselves with the petition initiatives in their counties, so what are we paying them for? Are these top notch lawyers, or do they have county jobs because they can’t make it in the private sector? Are they just another office used by the uniparty to maintain control of the status quo, or in other words, the jackboot of tyranny on the neck of the lowly taxpayer?

Now let’s think about this. How many people love lawyers? How many people blindly trust all lawyers and trust what they say is 100% truth because they are members of the State Bar? How many lawyers can you think of use the law as a weapon to further their agenda, win a case, or to financially benefit themselves? How many of you have heard of “lawfare” in election related cases since 2020? Ok then, that’s settled.

Sara Frankenstein, during her presentation, tells everyone that their petition has been denied before there was ever a motion or a vote by listing HER problems with it and then telling the citizens not to re-circulate another petition because that won’t pass either. Interesting, Sara. Also, Rep. Mary Fitzgerald parks herself in a seat at the commission table, right next to Frankenstein for the entire meeting. She is NOT a member of the board. Mary Fitzgerald is married to Judge John Fitzgerald. Also interesting. Sara and Mary both squirm when valid points are made by Nichole with facts, documents and law. They KNOW what they are doing is unethical, and they KNOW Nichole’s arguments are right.

Main point is this: Lawrence County Commission broke the law by denying the petition and the constitutional rights of the citizens that signed it.

McPherson County already turned in their petitions, and instead of following the law and reading the petition at their next meeting, the Commission read the ordinance proposed by the SA Austin Hoffman - which again - is an attempt to give the commission authority to throw out the petition - which they do not currently have! They pushed off the reading of the petition ordinance until April 2. Interesting.

The McPherson County Commission regularly breaks open meeting laws by “accidentally” posting the wrong meeting dates and having the meeting anyway without properly noticing the public, removing or not posting agenda items with out noticing the public, going into executive session to discuss agenda items, and more. Shouldn’t a good county attorney be ensuring all open meetings laws are followed by the commission?

The desperate attempts by the uniparty fake republicans in South Dakota are exposing them all at a such a rapid rate it’s hard to keep up!! Our constitutional and civil rights to a fair election where our votes are counted publicly have been sold out to ES&S and Bpro, private for-profit third party vendors, without asking us first! This corrupt system was ushered in with bribes from the federal government. And now, all these fake republican officials that were (s)elected by the system, are showing their disdain for the people they work for in their sick attempts to protect and defend machine vendors and money. Their sworn Oaths to the Constitution have just been violated. They should resign NOW.

Lawrence and McPherson County - have you pulled the surety bonds for your officials? Read SDCL 7-10-5. General duties relating to elections, 7-10-6. Call of special election when county commissioners fail to call. 7-10-9. Action against auditor and sureties for misconduct or omission of duty. 3-16-1. Willful failure to perform official duty as misdemeanor. 3-17-6. Grounds for removal of local officers from office.

THIRTY FIVE counties have started the petition process. The 80% who believe our elections are compromised are rising. The groundswell of action is terrifying the establishment. After three years of gaslighting from our seriously uninformed and negligent election officials that cast vote records don’t exist, legislative bills pushed through that strip our rights, socialists labeling themselves as republicans to deceive the public, collusion amongst elected officials and the State Bar Association to deny the rights of the citizens, yet another compromised Secretary of State turning her back on the people who elected her, and PACs formed with big money to primary true conservatives out office, it couldn’t be more apparent that South Dakota is being targeted. You are not safe here from communism.

Today is gift, USE IT. Your children and grandchildren’s futures hinge on your action or inaction. The future of our country is hopeless if we all sit here and feel sorry for ourselves. BUT, the future of our country can be saved from communism if we ALL DO SOMETHING NOW. The 2024 election will determine whether our country can be turned back to the ideals of her founding fathers, or if it goes straight off the cliff into communism. It isn’t up to Trump, Congress, or anyone that you “vote” for. It’s up to you and me. The real government of the United States of America.

The most beautiful thank you we received was from an elderly veteran who said thank you to those of us who are now fighting for him. He served his country but is now too old and too tired to fight; but he is so thankful for those of us who now carry the torch in defense of the Christian values and the Constitution, modeled after divine law, which made her the greatest nation in the history of mankind.
